Funding is expected to renew for an additional three (3) years. 2014-O-146 Authorizing the City Manager to enter into a Chapter 380 Economic Development Agreement with Plaza Partners for the restoration, operation, and ultimate ownership of the Plaza Theater to be utilized as performing arts, meeting, and reception venue that will create new job opportunities and renewed economic interest in Downtown Laredo. The agreement provides for the initial lease of the Theater at $1.00 per year followed by the transfer of title to occur at the time Plaza Partners, at its sole cost, has successfully completed renovation of the property in compliance with all applicable local ordinances and state and federal statutes and standards, and the property has become fully operational condition to occur within forty-two (42) months of the date of this agreement. The City will be responsible for payment of utility costs incurred for eighteen (18) months following the date of agreement. Funding is available in the Capital Improvement Fund. 2014-O-147 Setting the maximum speed limit on that section of Loop 20 within the city limits of the City of Laredo, Webb County, Texas approaching Spur 400 (Clark Blvd.) as 45 MPH from Mile Point 18.523 to Mile Point 20.274, as defined in the Texas Department of Transportation Control Section Map 0086-14, to be in effect during the construction of the overpass providing for the installation of appropriate signs to indicate new speed changes in the designated areas and providing for publication and effective date. 2014-O-148 Setting the new speed limit on sections of IH 35 within the city limits of Laredo, Webb County, Texas, to 35 Miles Per Hour from Hidalgo St. to approximately 270 feet North of Victoria St., 50 Miles Per Hour from approximately 270 feet North of Victoria St. to approximately 650 feet North of Scott St., and 65 Miles Per Hour Maximum and 50 Miles Per Hour Minimum from approximately 650 feet North of Scott St. to approximately 4,480 feet North of Loop 20, as defined in the Texas Department of Transportation Control Section Map 0018-06, providing for the installation of appropriate signs to indicate new speed changes in the designated areas and providing for publication and effective date. 2014-O-149 Amending Chapter 19, Motor Vehicle and Traffic, Article VIII, Stopping, Standing or Parking, of The Code of Ordinances, City of Laredo, Specifically, adding Section 19-364 (13) which establishes the East and West side of Larga Vista Drive, as a "No Parking/Tow Away" Zone, from SH 359 to approximately 200 feet North of SH 359, providing severability and for an effective date and publication. 2014-O-150 Authorizing the City Manager to execute a lease renewal with Duty Free Americas Inc., for approximately 22,500 sq. ft. warehouse located at 5511 Thomas Avenue at the Laredo International Airport. Lease term is for twelve (12) months commencing on October 9, 2014, and ending on October 8, 2015. Initial rent shall be $9,135.00 per month; providing for an effective date. 2014-O-151 Authorizing the City Manager to approve a sublease a portion of the leased premises approved by Ordinance No. 95-O-251 dated February 20, 1996 between the City of Laredo as LESSOR and L.A. Ventures Terminal, LTD., as LESSEE, for the premises described as Warehouse Suite 8B, which consists of approximately 11,267 sq. ft. of warehouse, office and showroom space located at 2822 E. Bustamante, Suite 8B and within Lot 8, Block 1 of the Laredo International Airport Subdivision Plat to Baker Distributing Company, L.L.C., a Delaware limited liability company as SUB-LESSEE, said lease provides for right to sublease subject to city approval, which approval shall not be unreasonably withheld. 2014-O-152 Authorizing the City Manager to execute a lease agreement between the City of Laredo, as LESSEE and Paul Young Properties, LTD., as LESSOR for an approximate 1,250 sq. ft. tract of unimproved land located at the southeast corner of the airport adjoining Paul Young properties. Proposed annual rent shall be $1,250.00 plus annual CPI rent adjustments and fair market rent appraisals at 10th and 20th anniversaries. Lease term is for thirty (30) years commencing on December 1, 2014 and ending on November 30, 2044; providing for an effective date. X. RESOLUTIONS 5. 2014-R-104 Authorizing the City Manager to enter into a Memorandum of Understanding with Immigration and Customs Enforcement (ICE), Special Agent in Charge (SAC), San Antonio, Texas, for the purpose of reimbursement of costs incurred by the Laredo Police Department in providing resources to joint operations/task forces. 6. 2014-R-106 Authorizing the City Manager to accept a contract with the South Texas Development Council (STDC) through funding from the Department of State Health Services (DSHS) as follows: 1. Ryan White Service Delivery $378,321.00 2. HIV State Services $133,700.00 These contracts with a total amount of $512,021.00 allow for the continuation of City of Laredo Health Department Ryan White Program and HIV/Health & Social Services to provide medical care, treatment, case management, testing and supportive care for the term period from September 1, 2014 through August 31, 2015. Authorizing the City Manager to ratify the payment of $18,165.59 for past legal invoices and approving the final invoice of $41,301.93 for legal services totaling $59,467.52 by the firm of Ogletree, Deakins, Nash, Smoak & Stewart, P.C., as it relates to the 2014 negotiations for the Collective Bargaining Agreement with Laredo Fire Fighters Association Local 872. Consideration for approval of the El Eden Recreational Facility Park Project as complete, release of retainage and other completed work and approval of final payment in the amount of $60,129.30 to Leyendecker Construction, Inc., Laredo, Texas. Final construction contract amount is $4,031,171.11. Funding is available in the 2006 C.O. Bond and 2007 C.O. Bond. (Approved by Finance Committee) 9. Consideration to renew service contract number FY12-101 with Eye-View Investigations and Security, Laredo, Texas, in an annual amount up to $548,964.00 to provide security guard services at various municipal operations. The term of this contract shall be for a period of two (2) years beginning as of the date of its execution and subject to future budget appropriations. Funding is available in the respective departmental budgets. (Approved by Finance Committee) 10. Consideration to award contract FY14-083 to sole bidder, Consolidated Electrical Distributors, (CED) Laredo, Texas in the amount of $551,972.00 for electrical fixtures and supplies for electrical repairs to damages at International Bridge I, Gateway to the Americas, caused by the flooding of the Rio Grande River during Hurricane “Alex”. Funding is available in the Bridge System Construction Fund. (Approved by Finance Committee) 11. Consideration to authorize the use of the State of Texas - Procurement and Support Services (TPASS) Division's Cooperative Purchasing Program of library materials. Approximately $840,885.00 in library materials is purchased on an annual basis. This contract will supplement the Library's ability to purchase books and audio visual materials. Consideration to authorize the purchase of two-thousand nine hundred and forty (2,940) garbage/refuse carts from Toter Inc., Statesville, North Carolina, through the H-GAC Cooperative Purchasing Contract GC01-13 in the total amount of $170,905.20. Consideration to award annual supply contract FY14-096 to the sole bidder, Neuhaus & Company, Weslaco, Texas in an amount up to $50,000.00, for the purchase of John Deere and Toro Original Equipment Manufacturer (OEM) repair parts for the City’s lawn maintenance equipment. All parts will be purchased on an as needed basis. The term of this contract shall be for a period of one (1) year beginning as of the date of its execution. If the pricing remains the same or price adjustment has mutual agreement from both parties and the City agrees to extend the contract, the contract shall automatically renew for another one (1) year period. Consideration to renew the existing annual service contract FY14-007 for the purchase of Original Equipment Manufacturer (OEM) parts/service for the City’s Caterpillar heavy equipment currently awarded to Holt CAT, Laredo, Texas, in an amount up to $325,000.00. The term of this contract shall be for a period of one (1) year beginning as of the date of its execution. All parts will be secured on an as needed basis. Consideration to renew annual contract FY14-016 for the repair and replacement of hydraulic cylinders for the City’s heavy equipment fleet to the following vendors: 1.Laredo Mechanical, Laredo, Texas, in an amount up to $65,000.00, and 2. Cervantes Truck Center, Laredo, Texas, in an amount not to exceed $70,000.00. All repair services will be secured on an as needed basis. All parts will be purchased on an as needed basis. (AS AMENDED) 2014-O-143 Amending the Zoning Ordinance (Map) of the City of Laredo by authorizing a Conditional Use Permit for an amusement redemption machine establishment on Lot 8, Block 480, Western Division, located at 815 Park Street; providing for publication and effective date. 2014-O-144 Amending the Zoning Ordinance (Map) of the City of Laredo by rezoning Lots 1 and 2, Block 88, Eastern Division, located at 103 Guadalupe Street, from R-3 (Mixed Residential District) and B-1 (Limited Commercial District) to B-3 (Community Business District); providing for publication and effective date. 2014-O-145 Authorizing the City Manager to accept and enter into contract with the United States Health and Human Services (HHS) Department Substance Abuse and Mental Health Services Administration (SAMHSA); amending the City of Laredo Health Department (CLHD) FY 2014-2015 budget by appropriating revenues and expenditures in the amount of $500,000.00; and amending the FY 2014-2015 Full Time Equivalent (FTE) Position Listing by creating one (1) Coordinator (Health Educator Supervisor, R38 position), one (1) Licensed Professional Counselor (Public Health Technician, R36 position), one (1) Medical Case Manager (Caseworker, R34 position), one (1) Health Educator I, R29 position and one (1) Clerk II, R25 position for the CLHD initiative to integrate HIV prevention and medical care with mental health and substance abuse treatment and prevention services for the term from September 30, 2014 through September 29, 2015. Funding is expected to renew for an additional three (3) years. 2014-O-146 Authorizing the City Manager to enter into a Chapter 380 Economic Development Agreement with Plaza Partners for the restoration, operation, and ultimate ownership of the Plaza Theater to be utilized as performing arts, meeting, and reception venue that will create new job opportunities and renewed economic interest in Downtown Laredo. The agreement provides for the initial lease of the Theater at $1.00 per year followed by the transfer of title to occur at the time Plaza Partners, at its sole cost, has successfully completed renovation of the property in compliance with all applicable local ordinances and state and federal statutes and standards, and the property has become fully operational condition to occur within forty-two (42) months of the date of this agreement. The City will be responsible for payment of utility costs incurred for eighteen (18) months following the date of agreement. Funding is available in the Capital Improvement Fund. 2014-O-147 Setting the maximum speed limit on that section of Loop 20 within the city limits of the City of Laredo, Webb County, Texas approaching Spur 400 (Clark Blvd.) as 45 MPH from Mile Point 18.523 to Mile Point 20.274, as defined in the Texas Department of Transportation Control Section Map 0086-14, to be in effect during the construction of the overpass providing for the installation of appropriate signs to indicate new speed changes in the designated areas and providing for publication and effective date. 2014-O-148 Setting the new speed limit on sections of IH 35 within the city limits of Laredo, Webb County, Texas, to 35 Miles Per Hour from Hidalgo St. to approximately 270 feet North of Victoria St., 50 Miles Per Hour from approximately 270 feet North of Victoria St. to approximately 650 feet North of Scott St., and 65 Miles Per Hour Maximum and 50 Miles Per Hour Minimum from approximately 650 feet North of Scott St. to approximately 4,480 feet North of Loop 20, as defined in the Texas Department of Transportation Control Section Map 0018-06, providing for the installation of appropriate signs to indicate new speed changes in the designated areas and providing for publication and effective date. 2014-O-149 Amending Chapter 19, Motor Vehicle and Traffic, Article VIII, Stopping, Standing or Parking, of The Code of Ordinances, City of Laredo, Specifically, adding Section 19-364 (13) which establishes the East and West side of Larga Vista Drive, as a "No Parking/Tow Away" Zone, from SH 359 to approximately 200 feet North of SH 359, providing severability and for an effective date and publication. 2014-O-150 Authorizing the City Manager to execute a lease renewal with Duty Free Americas Inc., for approximately 22,500 sq. ft. warehouse located at 5511 Thomas Avenue at the Laredo International Airport. Lease term is for twelve (12) months commencing on October 9, 2014, and ending on October 8, 2015. Initial rent shall be $9,135.00 per month; providing for an effective date. 2014-O-151 Authorizing the City Manager to approve a sublease a portion of the leased premises approved by Ordinance No. 95-O-251 dated February 20, 1996 between the City of Laredo as LESSOR and L.A. Ventures Terminal, LTD., as LESSEE, for the premises described as Warehouse Suite 8B, which consists of approximately 11,267 sq. ft. of warehouse, office and showroom space located at 2822 E. Bustamante, Suite 8B and within Lot 8, Block 1 of the Laredo International Airport Subdivision Plat to Baker Distributing Company, L.L.C., a Delaware limited liability company as SUB-LESSEE, said lease provides for right to sublease subject to city approval, which approval shall not be unreasonably withheld. 2014-O-152 Authorizing the City Manager to execute a lease agreement between the City of Laredo, as LESSEE and Paul Young Properties, LTD., as LESSOR for an approximate 1,250 sq. ft. tract of unimproved land located at the southeast corner of the airport adjoining Paul Young properties. Proposed annual rent shall be $1,250.00 plus annual CPI rent adjustments and fair market rent appraisals at 10th and 20th anniversaries. Lease term is for thirty (30) years commencing on December 1, 2014 and ending on November 30, 2044; providing for an effective date. X. RESOLUTIONS 5. 2014-R-104 Authorizing the City Manager to enter into a Memorandum of Understanding with Immigration and Customs Enforcement (ICE), Special Agent in Charge (SAC), San Antonio, Texas, for the purpose of reimbursement of costs incurred by the Laredo Police Department in providing resources to joint operations/task forces. 6. 2014-R-106 Authorizing the City Manager to accept a contract with the South Texas Development Council (STDC) through funding from the Department of State Health Services (DSHS) as follows: 1. Ryan White Service Delivery $378,321.00 2. HIV State Services $133,700.00 These contracts with a total amount of $512,021.00 allow for the continuation of City of Laredo Health Department Ryan White Program and HIV/Health & Social Services to provide medical care, treatment, case management, testing and supportive care for the term period from September 1, 2014 through August 31, 2015. Authorizing the City Manager to ratify the payment of $18,165.59 for past legal invoices and approving the final invoice of $41,301.93 for legal services totaling $59,467.52 by the firm of Ogletree, Deakins, Nash, Smoak & Stewart, P.C., as it relates to the 2014 negotiations for the Collective Bargaining Agreement with Laredo Fire Fighters Association Local 872. Consideration for approval of the El Eden Recreational Facility Park Project as complete, release of retainage and other completed work and approval of final payment in the amount of $60,129.30 to Leyendecker Construction, Inc., Laredo, Texas. Final construction contract amount is $4,031,171.11. Funding is available in the 2006 C.O. Bond and 2007 C.O. Bond. (Approved by Finance Committee) 9. Consideration to renew service contract number FY12-101 with Eye-View Investigations and Security, Laredo, Texas, in an annual amount up to $548,964.00 to provide security guard services at various municipal operations. The term of this contract shall be for a period of two (2) years beginning as of the date of its execution and subject to future budget appropriations. Consideration to award contract FY14-083 to sole bidder, Consolidated Electrical Distributors, (CED) Laredo, Texas in the amount of $551,972.00 for electrical fixtures and supplies for electrical repairs to damages at International Bridge I, Gateway to the Americas, caused by the flooding of the Rio Grande River during Hurricane “Alex”. Funding is available in the Bridge System Construction Fund. (Approved by Finance Committee) 11. Consideration to authorize the use of the State of Texas - Procurement and Support Services (TPASS) Division's Cooperative Purchasing Program of library materials. Approximately $840,885.00 in library materials is purchased on an annual basis. This contract will supplement the Library's ability to purchase books and audio visual materials. Consideration to authorize the purchase of two-thousand nine hundred and forty (2,940) garbage/refuse carts from Toter Inc., Statesville, North Carolina, through the H-GAC Cooperative Purchasing Contract GC01-13 in the total amount of $170,905.20. Consideration to award annual supply contract FY14-096 to the sole bidder, Neuhaus & Company, Weslaco, Texas in an amount up to $50,000.00, for the purchase of John Deere and Toro Original Equipment Manufacturer (OEM) repair parts for the City’s lawn maintenance equipment. All parts will be purchased on an as needed basis. The term of this contract shall be for a period of one (1) year beginning as of the date of its execution. If the pricing remains the same or price adjustment has mutual agreement from both parties and the City agrees to extend the contract, the contract shall automatically renew for another one (1) year period. Consideration to renew the existing annual service contract FY14-007 for the purchase of Original Equipment Manufacturer (OEM) parts/service for the City’s Caterpillar heavy equipment currently awarded to Holt CAT, Laredo, Texas, in an amount up to $325,000.00. The term of this contract shall be for a period of one (1) year beginning as of the date of its execution. All parts will be secured on an as needed basis. Funding is available in the Fleet Maintenance Budget. (Approved by Finance Committee) 15. Consideration to renew annual contract FY14-016 for the repair and replacement of hydraulic cylinders for the City’s heavy equipment fleet to the following vendors: 1.Laredo Mechanical, Laredo, Texas, in an amount up to $65,000.00, and 2. Cervantes Truck Center, Laredo, Texas, in an amount not to exceed $70,000.00. All repair services will be secured on an as needed basis. All parts will be purchased on an as needed basis. Consideration to renew annual supply contract FY14-008 for the purchase of Original Equipment Manufacturer (OEM) parts for the City’s fleet vehicle repairs to the following vendors: 1. Paul Young Auto, Laredo, Texas in an amount up to $50,000.00, and 2. Laredo Dodge Chrysler Jeep, Laredo, Texas in an amount up to $35,500.00, and 3. Freedom Chevrolet & Dodge, Dallas, Texas in an amount up to $20,000.00 The primary contract vendors are the local General Motors and Dodge Chrysler dealerships for these OEM parts contracts.The term of this contract shall be for a period of one (1) year beginning as of the date of its execution.
